2. Description of Service

Quizinger is an AI-powered platform that enables users to create quizzes, assessments, and educational content from various sources including PDFs, images, text, and handwritten notes. The Service utilizes artificial intelligence technologies from OpenAI and Google to generate questions and answers.

3. User Accounts

3.1 Registration

To access certain features of the Service, you must register for an account. You agree to provide accurate, current, and complete information during the registration process and to update such information to keep it accurate, current, and complete.

3.2 Account Security

You are responsible for safeguarding your account password and for any activities or actions under your account. You must notify us immediately upon becoming aware of any breach of security or unauthorized use of your account.

3.3 Account Termination

We reserve the right to terminate or suspend your account at any time, without prior notice or liability, for any reason whatsoever, including without limitation if you breach the Terms.

4. Use of Service

4.1 Acceptable Use

You agree to use the Service only for lawful purposes and in accordance with these Terms. You agree not to use the Service:

4.2 Content Restrictions

When uploading content to generate quizzes, you agree not to upload content that:

  • Is copyrighted, unless you own the copyright or have permission from the copyright holder
  • Contains hate speech, discrimination, or promotes violence
  • Is sexually explicit or pornographic in nature
  • Violates any third-party rights
  • Contains personal information of minors

5. Credits and Payment

5.1 Credit System

Certain features of the Service require credits. Free accounts receive 20 credits upon registration. Additional credits can be purchased through our pricing plans.

5.2 Payment

Paid subscriptions are billed in advance on a monthly basis. All fees are non-refundable except as required by law or as explicitly stated in these Terms.

5.3 Pricing Changes

We reserve the right to change our pricing at any time. Price changes will be communicated to users in advance and will apply to subsequent billing periods.

6. Intellectual Property Rights

6.1 Quizinger's IP

The Service and its original content, features, and functionality are and will remain the exclusive property of Quizinger and its licensors. The Service is protected by copyright, trademark, and other laws.

6.2 User Content

You retain all rights to the content you upload to the Service. By uploading content, you grant Quizinger a worldwide, non-exclusive, royalty-free license to use, reproduce, and process your content solely for the purpose of providing the Service to you.

6.3 Generated Content

You own the quizzes and questions generated by the Service. Quizinger claims no ownership over AI-generated content created through your use of the Service.

7. AI-Generated Content

7.1 No Guarantee of Accuracy

While we strive for accuracy, AI-generated questions and answers may contain errors. Users are responsible for reviewing and verifying all generated content before use.

7.2 Educational Purposes

Our Service is designed for educational purposes. AI-generated content should be reviewed by qualified educators before use in formal assessments.

8. Privacy and Data Protection

Your use of the Service is also governed by our Privacy Policy. Please review our Privacy Policy, which explains how we collect, use, and disclose information that pertains to your privacy.

9. Data Retention and Deletion

9.1 Content Storage

Uploaded files (PDFs, images) are processed and then automatically deleted from our servers. We do not permanently store uploaded source materials.

9.2 Generated Quizzes

Generated quizzes are stored in your account and can be accessed, edited, or deleted at any time.

9.3 Account Data

Account data is retained for the duration of your account. Upon account deletion, your data will be permanently removed within 30 days.

10. Third-Party Services

Our Service utilizes third-party AI services (OpenAI, Google Gemini) for content generation. Use of these services is subject to their respective terms and policies. We are not responsible for the availability, accuracy, or performance of these third-party services.

11. Limitation of Liability

To the maximum extent permitted by applicable law, in no event shall Quizinger, its affiliates, directors, employees, or licensors be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from:

  • Your access to or use of or inability to access or use the Service
  • Any conduct or content of any third party on the Service
  • Any content obtained from the Service
  • Unauthorized access, use, or alteration of your transmissions or content

12. Disclaimer of Warranties

The Service is provided on an "AS IS" and "AS AVAILABLE" basis. Quizinger makes no warranties, expressed or implied, regarding the Service, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

13. Indemnification

You agree to defend, indemnify, and hold harmless Quizinger and its licensors from and against any claims, liabilities, damages, judgments, awards, losses, costs, expenses, or fees (including reasonable attorneys' fees) arising out of or relating to your violation of these Terms or your use of the Service.
